General Terms

We do not allow Adult, Warez, illegal MP3 Sites or IRC Bots. You may not store more data in your account than your allotted virtual server space. Your virtual server (inc FTP and Telnet/SSH access – if applicable) is for your personal use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people.

Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your virtual server. You may not run server processes (eg. talkers/IRC Bots) from your virtual server. We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services. When your account is closed, all files (including web pages, etc.) will be deleted.

We reserve the right to cancel your account at any time without notice. We reserve the right to amend and update these Terms and Conditions at any time without notice. To protect your privacy we never distribute your name or e-mail address to any third parties. Users must not participate in any form of un-solicited bulk e-mailing or spam. By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.

Bandwidth

If your bandwidth reaches the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage.

Telnet/SSH

Telnetshell/SSH accounts are restricted, but are occasionally made available for editing and setting up your web site. It is not a development platform for issues unrelated to your web site. You must not leave you home directory at any time. You must not attempt to gain the privileges of another user. Interfering with the following files will result in your telnet access being removed – .bash_history – .bash_logout – .bash_profile – .bashrc.

Web Pages

Commercial use of web and ftp space is permitted. You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK/Singapore law. You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s). We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. AsiaFastHosts do not allow adult, warez or illegal MP3 web sites on their servers.

Domain Names

It is the customers responsibility to make sure their domain name does not expire. AsiaFastHosts will not be held responsible for any domain name that has expired and possibly bought by another individual / company.

Payment Policies

All accounts are set up on a prepay basis. Although AsiaFastHosts reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year following the date the account was established.

Customers will be notified 1 month in advance of their expiry date for any purchases made through AsiaFastHosts. In situations where the customer does not renew their web hosting package, AsiaFastHosts reserves the right to suspend services until the renewals are met.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. All payment is in British Pounds or Singapore Dollars.

Cheque Payment:

If you would prefer to order web hosting or domain names by post, then please send an email to billing@asiafasthosts.com. A local Bank Account will be required if customers require the facility to purchase domains and other services on-line. AsiaFastHosts cannot guarantee that a service will be provided until after any funds have been cleared. This is particuarly relevant to Domain Name registration!

Purchases online at AsiaFastHosts are made through PayPal – a industry leader in the field of ecommerce with offices in the UK and Asia. The security used is Thawte 2048 bit encryption systems. At the browser 128 Bit SSL is used.

Cancellation and Refund

AsiaFastHosts reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes AsiaFastHosts terms of service a refund will not be issued in the event of a cancellation.

Cancellation Rights

You have the right to cancel your web hosting order within 30 working days without giving a reason. The 30 days will not start until the web hosting plan has been set up. Where the customer exercises their right to cancel, we will return your money within 30 days of cancellation. Our 30 day money back guarantee excludes the refund of domain name registration fees and Secure Certificates (SSL).
If after 30 days, you decide to terminate your contract with AsiaFastHosts, upon update of NameServers away from AsiaFastHosts network, we will take this as notification of your intent to cancel our service. 72 Hours later, we will remove all access to our system, and any files / emails contained within.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold AsiaFastHosts harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against AsiaFastHosts, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless AsiaFastHosts against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with AsiaFastHosts server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from AsiaFastHosts server.

Definition

Our Managed Services SLA applies to you (“The Customer”), for any Managed Services from AsiaFastHosts (the “Services”), providing your account is not in arrears. The services covered by this SLA include:
- Web Site Availability
- Incoming Email Availability

99.999% Connectivity – Money Back Guarantee

For mission-critical application we will guarantee that our network will be available to you at least 99.999% of the time.
If you find that we fail to meet this promise, we will refund 1 day’s service for every 30 minutes that connectivity has been unavailable over and above 0.001% of the month, extending in value up to a maximum of your monthly subscription charge.

Exceptions

Customers shall not receive any credits under our Managed SLA in connection with any failure or deficiency of Web Site / Email availability caused by, or contributed by:

1. Circumstances beyond AsiaFastHosts reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, armed conflict, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third party services, virus attacks or hackers, failure of third party software (including, without limitation, ecommerce software, payment gateways, chat, statistics or free scripts) or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of this SLA;

2. Failure to access circuits to the AsiaFastHosts Network, unless the cause is solely due to AsiaFastHosts

3. Scheduled (notified) maintenance, as well as emergency maintenance and upgrades

4. Any DNS related issues outside of the control of AsiaFastHosts

5. Issues relating to customer access for POP/IMAP/SMTP and FTP

6. Failure due to customer’s actions / omissions (or actions / omissions of others acting with consent and on behalf of the customer), including, without limitation, coding / customer scripting (e.g. PHP, CGI, HTML), any negligence, willful misconduct, or use of services resulting in a breach of AsiaFastHosts “User Agreement”

Any outages elsewhere on the internet that prevent access to your account, such as ISP downtime etc. AsiaFastHosts is not responsible for Browser or DNS caching that may appears to make your site inaccessible, when others can still access it. AsiaFastHosts will only guarantee that are considered under our control: namely, our routers, servers and server links to the internet.

Credits

Any credits offered under the SLA will be allocated to your AsiaFastHosts hosting account. Any claim under the SLA must be made within 30 days of the event; claims following this time cannot be authenticated and hence no credit will be awarded. Customers are therefore requested to notify AsiaFastHosts of any network downtime immediately and upon confirmation that the network was unavailable as a result of AsiaFastHosts actions, a credit under the SLA will be calculated from the time that the network downtime was reported.

AsiaFastHosts (“AsiaFastHosts”) has the following Privacy Policy with respect to information gathered on Web pages hosted by AsiaFastHosts (“Service Pages”). Such information is received by both AsiaFastHosts and the owner of the Web site through which you may have requested AsiaFastHosts services (the “Client”). You should contact the Client to determine the privacy policy, if any, that applies to the Client’s collection and use of such information. However, in no event shall AsiaFastHosts be liable for the Client’s use or disclosure of such information.

The terms “we” and “us” refer to AsiaFastHosts.

The Information We Collect

This notice applies to all information collected on the AsiaFastHosts Web site or submitted to AsiaFastHosts at any time through any Service Pages. Personally Identifiable Information-When visiting AsiaFastHosts’s or any Client’s Web site and signing up for or using AsiaFastHosts services through any Service Page, you may choose to supply AsiaFastHosts with information that identifies you personally. Such transactions may include: administering a service, such as email, search, advertising sales, ecommerce; completing an order; shipping a product; replying to support requests; or contacting you if you have granted us permission to do so. Except as provided in this Privacy Policy and the End-User Agreement, we do not share this information with outside parties without your permission except to the extent that is necessary to administer the services we offer our Clients and End-Users or to comply in responding to subpoenas, court orders or other legal proceedings.

From time to time, we also use the information you provide about yourself or others to inform you of additions or improvements to the AsiaFastHosts services as well as conduct member surveys in order to improve our services. These communications will only be sent to the administrative account.
